Terms of Service

These terms apply to the use of the Discord bot “Pablo”, this website and the dashboard (together “Pablo”). The provider is Marcel Noah Weixelbaum, Leo-Mathauser-Gasse 72, 1230 Wien.

By inviting Pablo to a server, using its commands or signing in to the dashboard, you agree to these terms. Discord’s Terms of Service and Community Guidelines always apply as well.

Pablo provides features for Discord servers, including moderation and AutoMod, anti-nuke protection, music and radio, levels and ranks, an economy with shop and games, a cross-server Global Chat, tickets, Modmail, welcome messages and cards, birthdays, giveaways, temporary voice channels, stats channels, custom commands, social notifications, server backups, ban appeals and a web dashboard for setup. The core features are free. Pablo is a hosted service operated by us; it is not available for self-hosting. Features may change over time – we keep developing Pablo and may occasionally remove or rework something.

You may use Pablo if you are allowed to use Discord and meet the minimum age that applies there. Whoever invites Pablo to a server must have the necessary permissions on that server and is responsible for how Pablo is set up and used there.

Please use Pablo as intended. In particular, you may not:

• use Pablo for spam, harassment, hate speech, fraud or other unlawful content
• spread advertising, invite links, insults or prohibited content through the Global Chat
• abuse Modmail, custom commands or auto responses to send spam, mass mentions or unlawful content
• circumvent rate limits, security measures or Premium restrictions
• deliberately overload or attack the bot or dashboard, or exploit vulnerabilities
• play or distribute content through Pablo that you don’t have the necessary rights to

Server admins decide which features they enable – for example message logs, tickets, Modmail or the Global Chat. They are responsible for informing their members about this and for applying moderation fairly. Actions moderators take through Pablo (e.g. bans or warnings) and decisions on ban appeals are decisions of the respective server, not ours.

Server admins are also responsible for the content of their custom commands, auto responses, welcome messages and appeal forms.

Coins and shop items only exist within Pablo and the respective server. They have no monetary value, cannot be bought with or exchanged for real money and may be adjusted or reset by the server team or by us. The casino games are pure entertainment without real stakes.

In the Global Chat your messages appear on other servers you may not know. You are responsible for your own content. We may delete messages network-wide and exclude users or servers from the Global Chat if these rules are broken. You can opt out at any time with /globalchat optout.

Backups store a server’s roles, channels and permission settings – not messages or members. Restoring a backup changes the server and cannot be undone automatically; only admins can trigger it. We do our best to keep backups safe, but we don’t guarantee that a backup can always be restored completely, for example if Discord limits or permissions prevent it.

Premium is a paid server subscription that you buy in the Discord App Shop. It unlocks extended features and higher limits, such as 24/7 music and radio and more giveaways, feeds, backups, custom commands, shop items and stats channels. The purchase contract, payment, renewal, cancellation and refunds are handled by Discord under its terms. You can cancel in Discord under “Settings → Subscriptions”.

Premium applies to the server it was purchased for. When the subscription ends, Premium features are no longer available; all free features remain.

We work hard to keep Pablo running reliably, but we can’t promise constant availability. Maintenance, updates and outages at Discord or music platforms can cause downtime. You can see the current state on the status page.

You can remove Pablo from your server and log out of the dashboard at any time. We may exclude users or servers from Pablo and have the bot leave a server if these terms or Discord’s rules are broken. In that case you manage any paid Premium subscription through Discord.

We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the Austrian Product Liability Act (PHG).

In cases of slight negligence we are only liable for breaches of essential obligations on whose fulfilment you were entitled to rely, and only for foreseeable, typical damage. Otherwise, liability is excluded – in particular for content of other users, decisions of server moderators and content from music platforms or radio stations.

We may update these terms, for example when new features are added. We announce significant changes in advance, for example on this website or on our support server. If you continue to use Pablo afterwards, the new terms apply.

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in the EU, the mandatory consumer protection provisions of your country of residence remain unaffected.

If any provision is invalid, the remaining provisions remain in effect.
